Right of withdrawal

As a consumer, you have a right of revocation. A consumer within the meaning of § 13 of the German Civil Code (BGB) is any natural person who enters into a legal transaction for a purpose that can be attributed neither to his or her commercial nor to his or her independent professional activity.

You may revoke your contractual declaration in writing (e.g. letter, fax, e-mail) within 14 days without stating reasons or - if the goods are handed over to you before the deadline - by returning the goods. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the customer and also not before fulfilment of the information obligations according to Art. 246 § 2 in connection with § 1 Abs. 1 and 2 EGBGB as well as - for contracts in electronic business transactions - according to § 312g Abs. 1 S. 1 BGB in connection with Art. 246 § 3 EGBGB.

The timely dispatch of the revocation or the goods shall be sufficient to comply with the revocation period.

Consequences of revocation

In the event of an effective revocation, the services received by both parties shall be returned and any benefits derived (e.g. interest) shall be surrendered. In the event of deterioration of the goods and for uses which cannot be returned or which can only be returned in part or in a deteriorated condition, you must compensate us to the extent of the value. However, this only applies insofar as the use or deterioration is due to handling of the goods which goes beyond the examination of the characteristics and the mode of operation. A "test of the properties and functionality" is to be understood as the testing and trying out of the respective goods, as is possible and usual in a shop, for example.

Goods that can be sent by parcel post are to be returned at our risk. If it is not possible to return the goods as a parcel due to their weight or bulkiness, it is sufficient to send a request for return to COMEXIO GmbH in due time (14 days after receipt of the goods). The customer shall bear the regular costs of the return shipment if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of EUR 40.00 or if, in the case of a higher price of the goods, you have not yet provided the consideration or a contractually agreed partial payment at the time of the revocation. Otherwise, the return shipment is free of charge for you.

Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the sending of the notice of cancellation or the goods, for us with their receipt.

Exclusion of the right of revocation

The right of withdrawal does not apply to the delivery of customised goods or goods that are clearly tailored to personal requirements.

Als Verbraucher steht Ihnen ein Widerrufsrecht zu. Verbraucher im Sinne des § 13 BGB ist jeder natürliche Person, die ein Rechtsgeschäft zu einem Zwecke abschließt, der weder ihrer gewerblichen noch selbstständigen beruflichen Tätigkeit zugerechnet werden kann.

Sie können Ihre Vertragserklärung innerhalb von 14 Tagen ohne Angabe von Gründen in Textform (z.B. Brief, Telefax, E-Mail) oder – wenn Ihnen die Ware vor Fristablauf überlassen wird – durch Rücksendung der Ware widerrufen. Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Eingang der Ware beim Kunden und auch nicht vor Erfüllung der Informationspflichten gemäß Art. 246 § 2 in Verbindung mit § 1 Abs. 1 und 2 EGBGB sowie – bei Verträgen im elektronischen Geschäftsverkehr – gemäß § 312g Abs. 1 S. 1 BGB in Verbindung mit Art. 246 § 3 EGBGB.

Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufes oder der Ware.

Widerrufsfolgen

Im Falle eines wirksamen Widerufs sind die beiderseits empfangenen Leistungen zurück-zugewähren und ggf. gezogene Nutzungen (z.B. Zinsen) herauszugeben. Bei einer Verschlech-terung der Ware und für Nutzungen, die nicht oder teilweise nicht oder nur in verschlechtertem Zustand herausgegeben werden können, müssen Sie uns in soweit Wertersatz leisten. Dies gilt jedoch nur, soweit die Nutzungen oder Verschlechterungen auf einen Umgang mit der Sache zurückzuführen ist, der über die Prüfung der Eigenschaften und der Funktionsweise hinausgeht. Unter einer „Prüfung der Eigenschaften und der Funktionsweise“ ist das Testen und Ausprobieren der jeweiligen Ware zu verstehen, wie es etwa in einem Ladengeschäft möglich und üblich ist.

Paketversandfähige Waren sind auf unsere Gefahr zurückzusenden. Ist eine Rücksendung der Ware wegen des Gewichts oder der Sperrigkeit als Paket nicht möglich, genügt die fristgerechte (14 Tage nach Erhalt der Ware) ein Rücknahmeverlangen an die COMEXIO GmbH. Der Kunde hat die regelmäßigen Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Ware einen Betrag von 40,00 EUR nicht übersteigt oder wenn Sie bei einem höheren Preis der Ware die Gegenleistung oder eine vertragliche vereinbarte Teilzahlung zum Zeitpunkt des Widerrufs noch nicht erbracht haben. Andernfalls ist die Rücksendung für Sie kostenfrei.

Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für Sie mit dem Absenden der Widerrufserklärung oder der Ware, für uns mit deren Empfang.

Ausschluss des Widerrufsrechts

Das Widerrufsrecht besteht nicht bei Lieferung von kundenspezifisch angefertigter Ware oder Ware die eindeutig auf persönliche Bedürfnisse zugeschnitten ist.
